Job description
Assistant City Attorneys review, negotiate, and draft contracts and participate in other transactional work; provide client support; defend litigation; engage in government law practice; and handle all legal matters of the assigned client department. They are expected to perform difficult professional and administrative legal work, including revisions to the Phoenix City Code, and to consult with client decision makers regarding relevant legal issues. These attorneys may also be required to staff public meetings and represent the City during administrative hearings or court proceedings. Assistant City Attorneys report to an Assistant Chief Counsel and generally work independently in performing their duties. All attorneys in the Law Department are assigned and may be reassigned based on the best interests of the City, as determined by the City Attorney.
The City of Phoenix Law Department is comprised of two sections, the City Attorney's Office, which handles representing the City in civil matters, and the City Prosecutor's Office, which handles the prosecution of misdemeanor crimes committed in Phoenix.
Assistant City Attorneys in the Civil Division of the Law Department work in one of six areas: Land Use; Public Safety; Litigation; Transportation; Human Resources; and Community Services.
The City has an immediate need for Assistant City Attorney IV to fill openings in the Law Department advising the following departments and specialties:
- Human Resources Department/Health Benefits and Contracts.
- Requires experience managing employee health benefits, fringe benefits, and wellness programs for public sector employees.
- Experience with the regulations and regulatory bodies that impact public sector health benefits programs is required, including by not limited to the ACA, CAA, IRS, and HHS.
- Community & Economic Development Department (CEDD) .
- A background in municipal law, transactional work, real estate and land use law is a plus.
- Job duties will include: drafting and negotiating development agreements, ground leases, intergovernmental agreements and other contracts; assisting CEDD on procurements for development opportunities and professional services; and responding to public records requests directed to CEDD.
- Police Misconduct Investigations.
- Provides consultation and review of active and completed PPD internal misconduct investigations for legal and policy compliance, risk assessment, and policy recommendations.
- Reviews department policies for legality and liability issues and provide recommendations for policy updates aligned with new and developing federal and state case law and legislation.
- Will work with Human Resources to ensure department compliance with MOUs and City Personnel Policies.
- Phoenix Police Department (PPD) academy training and consultation.
- Will provide required legal updates for certified law enforcement personnel in criminal and civil law and required legal training for police cadets.
- Will monitor state and federal legislative activity and case law to create and implement necessary training in new and developing areas of law that impact law enforcement and public safety.
- Will provide recommendations for updated training and assist in ensuring legal compliance with Department general operation orders and state and federal rules and regulations for law enforcement certification.

IDEAL CANDIDATE
- The ideal candidate has experience with municipal law practice including public records, procurement, and general liability law.
- Has a high professional and ethical standing in the legal community.
- Possesses knowledge of municipal law, including open meetings, public records, conflicts, procurement, and liability issues.
- Displays a willingness to work extended hours and a flexible schedule.
SALARY
Up to $155,251.20 annually. Salary commensurate with experience and qualifications. The City contributes 9% of salary into 457/401(a) plans with no matching required. $3,600/annual car allowance and $1,440/annual cell phone allowance.
Effective July 10, 2023, a 5.23% increase to the base wage increase will go into effect.
The City of Phoenix is currently undergoing a classification and compensation study, moving one step closer to our goal of becoming a market leader and Arizona’s premier public sector employer. Salary range adjustments from the study will take effect, pending final approval from the City Council, on August 7, 2023.

MINIMUM QUALIFICATIONS
- Four years of experience as a practicing civil or criminal attorney.
- Experience in the practice of municipal law; the review, negotiation, and drafting of contracts or other primary responsibility for participation in transactional work.
- Experience with significant client contact; primary responsibility for civil litigation, and pleading and motion-practice.
- One year of government law practice; and a working knowledge of the legal subject matter involved with the department to which assignment will be made.
- Juris Doctor from an accredited school of law and admission to the State Bar of Arizona (or from a state with Arizona bar reciprocity). PREFERRED QUALIFICATIONS

- Experience working with legal-services contracts.
- Experience with conflict resolution and creativity in alternative problem-solving techniques.
- Experience negotiating and drafting development agreements.
- Experience with municipal law including public records, procurement and open meeting law.
- Experience drafting and negotiating complicated contracts or other transactional work is also preferred.
- Experience with municipal law practice including planning and development, zoning ordinances, land use rules/regulations, and working with the development community.
- Experience advising on public sector benefits matters, including health benefits, fringe benefits, and wellness programs.
