This position reports to the Presiding Judge for administrative duties, projects and general direction.

Characteristic Work of the Position

Nature: The power to appoint, approve authority granted, assign duties, supervise, and remove rests with the Circuit Judge for Kewaunee County and/or the Chief Judge of the administrative district.

The appointee serves at the discretion and pleasure of the Circuit Judge for Kewaunee County and/or the Chief Judge of the administrative district.

Example of Duties Register in Probate:

1. The responsibilities and authority as Register in Probate/Probate Registrar may include, but is not limited to, that specified in §851.72, 851.73, 851.75, and 865.065 Wis. Stats.

2. Maintains all Probate court records including probate, trusts, guardianships, conservatorships, alcoholic, mental and drug commitments, an other miscellaneous records. Maintains all records and files in current status, certifies when records are proper; prepares records for Court of Appeals.

3. Clerks in the courtroom for contested probate, guardianship, and commitment hearings. Duties include taking minutes, marking exhibits, etc.

4. Provides information and guidance to attorneys and the public who probate estates and confers with them regarding practices and procedures of Probate Court. Advises attorneys and the public regarding changes in: tax, estate, trust, guardianship, and mental health laws.

5. Arranges for psychologists and physicians to examine mentally ill patients.

6. Determines jurisdiction, collects all information regarding the estate, including cash values, types of assets, heirs, number and type of bequests, establishment of trusts and charitable gifts.

7. Fixes the amount and sufficiency of bonds.

8. Conducts hearings in all non-contested probate matters. Admits wills to probate, issues letters of authority for personal representatives and trustees. Approves inventories and accounts.

9. Schedules and conducts hearings for determination and proof of heirship in accordance with Wisconsin Statutes.

Example of Duties Family Court Commissioner:

1. The responsibilities and authority as Court Commissioner, Family Court Commissioner, and Probate Court Commissioner may include, but is not limited to, that specified in §757.68, 757.69 and portion of Chapter 767, Wis. Stats.; and Supreme Court Rule 75.

2. Perform duties as Family Court Commissioner by conducting hearings on child custody and placement, child support and other family-related court matters; providing parties to an action affecting the family with information of services offered by the office of family court commissioner as well as information regarding procedures, major issues, and community resources relative to actions filed in family court.

3. As needed, perform duties as Circuit Court Commissioner, including but not limited to conducting select circuit court hearings, and reviewing various court filings and petitions as well as search warrants.

Example of Duties Register in Probate and Family Court Commissioner:

1. Collates information for court proceedings. Schedules matters before the Court, issues orders for hearing, and presents the Court with concise information and issues involved.

2. Appoints attorneys to serve as guardian ad litem.

3. Reviews and processes bills, invoices and vouchers. Collects records and deposits all statutory fees. Prepares and maintains monthly and annual reports on fees. Prepares annual budget for consideration by County Board.

Qualifications:

Essential Knowledge and Abilities

1. Thorough working knowledge of all provisions of Chapter 767 of the Wisconsin Statutes (“Actions Affecting the Family”), all statutes relating to Register in Probate duties and general knowledge of the Justice system.

2. Knowledge of the purpose, functions, scope, statutory powers and rules, and limitations of the Probate Court, and Register in Probate Office.

3. Knowledge of Marital Property Law.

4. Ability to analyze situations, interpret legal documents and reports, and objectively make decisions and deliver judgment in court cases in accordance with laws, legal precedents, regulations and established procedures.

5. Ability to professionally communicate clearly, both verbally and in writing, with the general public, legal professionals, the Court, Judges, state officials, attorneys, and agencies.

6. Capable of supervising job performance of Deputy and provide guidance for personal growth training.

7. Ability to maintain and provide accurate and complete court records and reports. Ability to complete complex oral and written instructions.

8. Knowledge of modern office practices and procedures.

Training and Experience

1. A Juris Doctor degree, with a minimum of 3 years of related work experience including experience in the practice of law, or a combination of education and experience sufficient to successfully perform the essential duties of the job such as those listed above.

2. Current license to practice law in the State of Wisconsin.

Physical Demands

Tasks performed are inside and protected from the weather. Most work is completed in a sedentary position and in a normal office setting. While performing the duties of this job one may be required to sit for a period of up to 2 hours. The employee must be able to receive and enter information using a standard computer operating system. The employee must be able to review and sign documents and records relevant to this position. The employee is required to stand, walk, use hands and fingers, feel, push, pull, reach with arms, hands above and below shoulders, stoop, kneel, crouch and crawl. The employee may occasionally lift or move up to 25 pounds.

Job Type: Full-time

Pay: $95,534.00 - $104,457.00 per year
